What is the SAFE Banking Act?

The Secure and Fair Enforcement Banking Act protects businesses from being penalized by their federal regulator for providing financial services to legitimate marijuana-related businesses (MRB). It also says that proceeds from a transaction involving activities of a legitimate MRB are not considered proceeds from unlawful activity.

The bill was first introduced in the U.S. House of Representatives in 2019 with overwhelming support (321-103). Once it moved to the Senate, it died in committee. The bill was reintroduced in 2021 where it again passed the House of Representatives. It is now in the Senate, where it has been referred to the Committee on Banking, Housing, and Urban Affairs. We continue to monitor this important bill.
